By accessing or using Pinged ("the Service"), operated by Pinged ("we," "us," or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service. We reserve the right to update these terms at any time, and continued use of the Service constitutes acceptance of any changes. Each time you access or use the Service, you signify that you have read, understand, and agree to be bound by these Terms.
IF YOU DISAGREE WITH ANY OF THESE TERMS, DO NOT ACCESS OR USE THE SERVICE.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement. The Service is designed for adults navigating the dating landscape and is not intended for use by minors. If we discover that a user is under 18, we will immediately terminate their account.
Pinged is a community-driven platform that allows users to look up phone numbers and view aggregated, anonymized activity data submitted by other users. The Service provides real-time health status indicators, user-submitted reports, dating app flags, and badges based on community-reported data. Pinged does not perform background checks, verify identities, or access private telecommunications records. All data displayed is generated entirely by users of the platform. The Service is currently available for U.S. and Canadian phone numbers only.
Pinged is designed to promote safety and transparency in dating. The platform is intended for personal, non-commercial use to help individuals make informed decisions about their own dating lives. The Service should be used responsibly and in good faith. Any use of the Service that falls outside of this intended purpose, including but not limited to stalking, harassment, commercial data mining, or any unlawful activity, is strictly prohibited and may result in immediate account termination.
Pinged is NOT a consumer reporting agency as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA"). The information available through the Service has not been collected, in whole or in part, for the purpose of furnishing "consumer reports" as defined by the FCRA. The additional protections afforded to consumers, and obligations placed on consumer reporting agencies, are not contemplated by, nor contained within, these Terms.
You may NOT use information obtained from the Service for any purpose covered by the FCRA, including but not limited to:
Pinged is a platform for user-generated content. All pings, reports, flags, badges, and associated data are created and submitted by individual users of the Service — not by Pinged. In accordance with Section 230 of the Communications Decency Act (47 U.S.C. § 230), Pinged is not the publisher or speaker of any user-generated content and shall not be held liable for content posted by its users.
We do not verify, endorse, or guarantee the accuracy, completeness, or reliability of any user-submitted information. The presence of reports, flags, or badges on a phone number does not constitute a factual determination of wrongdoing by the owner of that number. Users should exercise their own judgment when interpreting data displayed on the platform.
To use certain features of the Service, you must create an account and verify your phone number via SMS. Each account must be tied to a unique, verified phone number. You may not create multiple accounts or use another person's phone number for verification. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
Violation of this policy may result in immediate termination of your account without notice or refund. We reserve the right to investigate and bring claims for violations to the fullest extent of the law.
You may not use, or allow any third party to use, the Service or any data obtained through the Service for any marketing purposes, including making telemarketing calls, transmitting unsolicited advertisements via email, SMS, paper mail, or fax. You may not use the Service to prepare, append, verify, or create any database. Data obtained from the Service may not be published, sold, rented, sublicensed, or redistributed to any third party in any form. Any commercial use of the data is strictly prohibited without our prior written consent.
The information displayed on Pinged is based entirely on anonymous, user-submitted data. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY INFORMATION ON THE PLATFORM. Health status indicators, badges, reports, and flags are algorithmically generated from user activity and do not represent verified facts. A "Critical" health status or a "Catfish Warning" badge does not mean the phone number owner has engaged in any wrongdoing — it only reflects the volume and nature of user-submitted reports.
Pinged shall not be liable for any errors or omissions in user-generated content. You agree to rely on the information available through the Service at your own risk.
By using the Service, you consent to receive electronic communications from us, including but not limited to: SMS messages for phone verification, email notifications regarding activity on monitored phone numbers (if subscribed), and service-related announcements. You represent and warrant that you have the legal authority over any phone number and email address you provide to us. You may opt out of marketing communications at any time, but service-related messages (such as verification codes) are required for use of the Service.
Certain features of the Service, including email notifications, require a paid subscription. By subscribing, you agree to pay the applicable fees as displayed at the time of purchase. Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You may cancel your subscription at any time through your account settings. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL BILLING PERIODS OR UNUSED FEATURES. We reserve the right to change subscription pricing with 30 days' notice.
If you believe your phone number has been unfairly targeted or you wish to request removal of data associated with your number, you may submit a request by contacting us at [email protected]. We will review all requests and may, at our discretion, take appropriate action regarding the data in question.
Please note that a removal request only affects data available through the Service and cannot remove information from third-party sources. We are not responsible for informing any third party of changes you request. We reserve the right to deny requests that we believe are made in bad faith or for the purpose of concealing harmful behavior.
You agree to indemnify, defend, and hold harmless Pinged, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use or misuse of the Service; (b) any content you submit to the Service; (c) your violation of these Terms; (d) your violation of any rights of another party; or (e) any actual or threatened suit, demand, or claim arising from your use of the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINGED AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY. IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF U.S. $100.00 OR THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
Some states do not allow the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy between you and Pinged arising out of or relating to the Service or these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court. Arbitration means the dispute will be resolved by a neutral arbitrator instead of a judge or jury.
YOU AND PINGED EACH WAIVE ALL RIGHTS TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE PROCEEDING. Any dispute resolution proceedings will be conducted only on an individual basis.
If you have a dispute with Pinged, you must first send written notice describing the dispute to [email protected] to allow us an opportunity to resolve the dispute informally through negotiation. The parties agree to negotiate in good faith for no fewer than 30 days after notice has been provided.
This arbitration agreement shall survive termination of these Terms.
We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions in Section 15.
These Terms, together with our Privacy Policy, constitute the entire and exclusive agreement between you and Pinged regarding the Service, and supersede and replace any prior agreements between you and Pinged regarding the Service.
